Find your Martyn's Law tier

Answer three questions to see whether your premises are likely to be in scope of the Terrorism (Protection of Premises) Act 2025 - and what you'd need to do before its main duties come into force, expected in spring 2027.

How do I work this out?

Use the busiest realistic moment, not your average. The Home Office suggests methods such as:

  • The maximum occupancy in your fire risk assessment
  • A capacity limit on your premises licence or safety certificate
  • Your fixed seats plus standing areas
  • Your busiest day on record - tills, door counts or bookings
  • The maximum tickets or registrations you issue

Always include staff, and write down which method you used.

3. A couple of quick checks
Is there a building on the site?
Is it open to the public, customers or members? This only matters for shops, food and drink, leisure, halls, libraries, museums and public buildings.

General guidance based on GOV.UK, not legal advice. We keep anonymous counts of results; your email is only stored if you ask us to send your result.

Your result will appear here Standard tier, enhanced tier or out of scope - with what it means for you.
